2. In this case, the petitioner is seeking regular bail in connection with Excise P.S. Case No. 95 of 2024, registered for the offences punishable under Section 30(a) of Bihar Prohibition & Excise Act, 2016.

3. As per allegation, on a secret information, the informant along with other police party asked the petitioner to stop his vehicle but he started fleeing away and was later apprehended. On search, 3 kg of illicit ganja was recovered from his possession.

Patna High Court CR. MISC. No.25363 of 2024(3) dt.24-07-2024 2/2 implicated in this case. He is a person of clean antecedent and is under custody since 17.01.2024. He has submitted further that the quantity of ganja which is alleged to have been recovered, is smaller than the commercial quantity.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge(Excise) Court No.-II, Muzaffarpur in connection with Excise P.S. Case No. 95 of 2024, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) Before release, the learned court below shall verify the criminal antecedent of the petitioner and if it is found that he is involved in any other case of similar nature except the present one, his bail bond shall not be accepted. (Nawneet Kumar Pandey, J) kundan/- U T
