JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-01-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 467, 468, 411, 120-B of the Indian Penal Code and Sections 25(1-B)a, 26 and 35 of the Arms Act.
Petitioner and others were arrested in Kanti P.S. Case No. 493 of 2018 and in the aforesaid Kanti P.S. Case No. 493 of 2018, one Scorpio bearing registration No. BR 06 PD O539 was seized. However, subsequently, the present case was lodged against the petitioner and others on the ground that they got prepared forged documents of the aforesaid Scorpio vehicle. Learned counsel appearing for the petitioner submits
Patna High Court Cr.Misc. No.182 of 2019(2) dt.17-01-2019 2/2 that having more or less similar allegation one co-accused, namely, Uday Kumar Jha has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 12.12.2018 passed in Cr. Misc. No. 73704 of 2018. It is also pointed out by him that petitioner does not have any criminal antecedents except the present case as well as the Kanti P.S. Case No. 493 of 2018.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 879 of 2018.
