The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. It is a case of recovery of about 13 liters of country made Mahua liquor from the boring which belongs to the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner has not been apprehended at the spot.

Learned APP appearing for the State has opposed the

Patna High Court CR. MISC. No.31263 of 2021(3) dt.23-03-2022 2/2 prayer for anticipatory bail.

From perusal of the case diary, it appears that the aforesaid Mahua liquor was recovered from the boring which belongs to the petitioner, as such, I am not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner is rejected.
