JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code.

The prosecution case is that the stolen motorcycle was recovered from the house of co accused Ajit Kumar who confessed that he purchased the same from the petitioner. It is submitted by the learned counsel for the petitioner that there is nothing on record to show that the motorcycle was sold by the petitioner and the motorcycle was ever in possession of the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named

Case No.171 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
