The petitioner apprehends his arrest in connection with Complaint Case No. 360(C) of 2018 registered under Sections 406 and 420 of the Indian Penal Code. Learned counsel for the petitioner submits that on the request of the learned counsel for the petitioner and the opposite party no. 2, the matter was referred to Mediation and Conciliation Centre, Patna, from settlement of dispute, where the dispute in between both parties have been amicably settled
Patna High Court CR. MISC. No.79780 of 2018(3) dt.02-05-2019 2/2 in terms of agreement as detailed in memorandum of agreement attached with Mediators Report dated 08.04.2019. In view of the agreement attached with Mediators Report dated 08.04.2019 disclosing that petitioner and the opposite party no. 2 have settled their dispute and in terms of agreement, cash of Rs.1,00,000/- was given by the petitioner to opposite party no. 2 and for remaining amount of Rs.3,75,000/- three post dated cheques were handed over to the opposite party no. 2, which is to be presented for encashment on 10.05.2019, 10.06.2019 and 10.07.2019, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-XII, Bhojpur, Ara, in connection with Complaint Case No. 360(C) of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
