2. The petitioner seeks regular bail in connection with Bidupur P.S. Case No. 783 of 2024 registered for the offence under Sections 304 of the Bharatiya Nyaya Sanhita, 2023 and later on Section 309(4) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 was added.
3. As per the prosecution case, two unknown criminals came on a motorcycle and snatched the purse of the informant's wife containing Rs. 5,000/-, two gold rings and a mobile phone from the wife of the informant and fled away. In the course of the crime, the wife of the informant fell down from the bike and got injured.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.24131 of 2025(2) dt.30-04-2025 2/3 petitioner is innocent and has not committed any offence. Petitioner is in custody since 30.12.2024. He further submits that there is no recovery from the petitioner and no TIP of the petitioner has been held.
5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.
7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur/concerned Court below in connection with Bidupur P.S. Case No. 783 of 2024 subject to condition that:- (i). The petitioner will mark his attendance at the Industrial Area Police Station, Vaishali at Hajipur on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
(ii) The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bond of the petitioner.
(iii). The bailors should be close blood relatives.
