No. 22329 of 2016 to the extent of extending the period of provisional anticipatory bail granted to the petitioner.
The petitioner, being the husband of the complainant, was granted provisional anticipatory bail for six months in connection with Barachatti P.S. Case No. 42 of 2016 registered for the offences punishable under Sections 498A/34 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act. The accusation is of torture for nonfulfillment of the dowry demand. It is submitted by learned counsel for the petitioner that since the petitioner was confined by the in-laws,
Patna High Court Cr.Misc. No.28898 of 2017 (2) dt.06-09-2017 2/2 hence, he could not surrender in pursuance to the order dated 18.05.2016 passed in Cr. Misc. No. 22329 of 2016. However, petitioner and the informant are residing together. In the circumstances, the period of provisional anticipatory bail is extended till 16th of October, 2017 in connection with Barachatti P.S. Case No. 42 of 2016, pending in the Court of learned SDJM, Sherghati, Gaya. The provisional bail will be confirmed by the learned Court below when the petitioner and the informant will appear before the learned Court below on 09.10.2017 and they will file an affidavit that the issue has been reconciled between the petitioner and the informant.
