In this case, the petitioners are seeking anticipatory bail in connection with Naokothi P.S. Case No. 20 of 2018 registered for offence punishable under sections 302, 304(B), 328, 201, 34 of the Indian Penal Code.
As per allegation, on account on non-fulfillment of demand of dowry led to death of the deceased. Further said that after the death, they have disposed of the dead body of the deceased with the intention to disappearance of the evidence. The case diary has been called for and from perusal of the same it appears that the independent witnesses have narrated that after the marriage, the son of the petitioners was
Patna High Court Cr.Misc. No.77596 of 2018(5) dt.13-02-2019 2/2 living separately and staying in Sasural. Two days before, he had come, incident to death has taken place. Whatever he was earning, he handed over the money to his wife. As per the learned counsel for the petitioners, the petitioners have been living separately with his son and deceased.
In such view of the matter, the prayer for bail of the petitioners is allowed and they, in the event of arrest or surrender before the court below within six weeks from today, are directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class, Begusarai in connection with Naokothi P.S. Case No. 20 of 2018, subject to the conditions as laid down under section 438 Cr. PC and also subject to the condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. The petitioners will not induce any witness or tamper with the evidence. The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.
