JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-05-2019 This application, for grant of anticipatory bail, arises out of Phulwaria P.S. Case No. 149 of 2018, disclosing offences under Sections 120(B) and 414/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. Police on information that 13 accused persons is carrying the liquor for selling, on which, police raided the place and arrested them and there was recovery from their house and motorcycle and one of the apprehended persons disclosed the name of petitioner.

Submission of learned counsel for the petitioner is that he has no criminal antecedent and has falsely been made accused in this case and nothing has been recovered either from the house of the petitioner or at his instance. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Begusarai, in connection with Phulwaria P.S. Case No. 149 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
