JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 23-06-2017 Heard learned counsel for the petitioners and learned counsel representing the State.

The petitioners apprehend their arrest in connection with Dawath P.S. Case No. 10 of 2017, registered for the offences punishable under Sections 188, 189, 332, 341, 353, 414, 504, 506 of the Indian Penal Code.

Allegedly, the petitioners talked with the informant in hot words and they were with a suspected vehicle for which no paper was produced and they caused threats, one Vijay Singh telephonically also caused threats and thereafter that vehicle was seized.

Submission is of false implication and that no offence

Patna High Court Cr.Misc. No.18901 of 2017 (3) dt.23-06-2017 2/2 as alleged is made out, the petitioners are law abiding citizens, they have not uttered hot words to the informant. The seized tank lorry was of Lalita Prasad who had given the same to Vijay Singh to ply on road and, as such, the petitioners deserve sympathetic consideration.

The learned A.P.P. opposes the prayer of pre-arrest bail.

In the facts and circumstances as stated above, the petitioners in the event of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Vikramganj at Rohtas (Sasaram), in connection with Dawath P.S. Case No. 10 of 2017, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
