The petitioners seek bail in anticipation of their arrest in connection with Sultanganj P. S. Case No. 119 of 2016 dated 04.07.2016 instituted for the offences under Section 395 of the Indian Penal Code.
The petitioners have been named by two arrested accused persons. Nothing has been recovered from the possession of the petitioners and this Court has been informed that two accused persons have been acquitted because to paucity of evidence.
The petitioner no. 1 earlier had filed a bond for
Patna High Court Cr.Misc. No.79775 of 2018(2) dt.16-01-2019 2/2 keeping good behaviour for a year, whereas petitioner no. 2 does not have any criminal antecedents.
For the aforesaid facts, the petitioners, abovenamed, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Sultanganj P. S. Case No. 119 of 2016, subject to the conditions as laid down under Section 438 (2) Cr.P.C. (Ashutosh Kumar, J) skm/- U
