The petitioner seeks bail in a case registered under Sections 272, 273, 414 of the Indian Penal Code and Section30(a)(d) of the Bihar Prohibition and Excise Act, 2016. The prosecution case, in short, is that 35 liters wine is recovered.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioner is in custody since 27-12-2018. Charge sheet in this case has already been submitted. It is alleged that 35 litres wine is recovered by side of the Sulabh Shauchalaya. There is no compliance of Section 100 Cr.P.C.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya in connection with Atri P.S. Case No. 453 of 2018.
