JUSTICE BIRENDRA KUMAR ORAL ORDER 16-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 20/22 of the N.D.P.S. Act. About 250 grams Ganja was allegedly recovered from the possession of the petitioner. Petitioner is in custody since 19.10.2016.
Submission of the petitioner is that petitioner has got no criminal antecedent and the recovered quantity comes within a small quantity.
Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like
Patna High Court Cr.Misc. No.55426 of 2016 (2) dt.16-01-2017 2/2 amount each to the satisfaction of learned Additional Sessions Judge-X, Patna/Successor Court, in connection with Dulhin Bazar P.S. Case No.194 of 2016.
