Permission is granted to make correction during the course of day.

Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Malaypur P.S. Case No. 02 of 2021 instituted for the offence under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 27.02.2021, charge-sheet has been submitted in the case and has got criminal antecedents as mentioned in paragraph '3' of the bail application. Learned counsel for the petitioner submits that from

No.32363 of 2021(2) dt.29-11-2021 2/3 bare perusal of the allegation as alleged in the F.I.R. it would manifest that the informant has alleged that the petitioner along with another co-accused tried to commit loot of his motorcycle but in the meantime police came and on chase, the petitioner was arrested. Learned counsel for the petitioner submits that it was a failed attempt to commit the loot of motorcycle. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner and submits that petitioner has got six criminal antecedents as mentioned in paragraph '3' of the bail application.

Considering the fact that the petitioner is in custody since 27.02.2021, charge-sheet has been submitted in the case and it was a failed attempt to loot motorcycle, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui in connection with Malaypur P.S. Case No. 02 of 2021 subject to the condition as laid down under Section 437 (3) Cr.P.C. with a condition that the petitioner, till the trial commences, will mark his attendance in the concerned police station on 15th of every month commencing from December, 2021 and in the event it is reported to the learned court below that the petitioner has not
