JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 18-01-2017 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

The petitioner seeks bail in connection with Beur P.S. Case No. 127/2015, corresponding to S.Tr. No. 922/2015, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code.

The petitioner wants to renew the prayer of bail which was earlier rejected by order dated 24.02.2016 passed in Cr. Misc. No. 57370/2015 on the ground that in this case other co-accused Sonu Kumar and Amit Kumar Mandal have been allowed bail having similar allegation and as such, now the petitioner also deserves sympathetic consideration. In the facts and circumstances stated above, now the petitioner, above named, is directed to be released on bail on execution of bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge IX, Patna in connection with Beur P.S. Case No. 127/2015, subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
