2. The petitioner seeks bail in a case registered for the offence under Sections 8(b), 18 and 29 of the N.D.P.S. Act.

3. As per the prosecution case, it is alleged that this petitioner is involved in illegal cultivation of opium plants on large scale over the forest land.

4. Learned counsel for the petitioner submits that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case merely on suspicion. He further submits that neither the petitioner was involved in illegal cultivation of opium plants nor was present at the time of alleged occurrence. Patna High Court CR. MISC. No.30379 of 2026(3) dt.17-07-2026 2/2 already been granted privilege of anticipatory bail by this Court vide order dated 27.09.2024 passed in Cr. Misc. No. 59289 of 2024. Moreover, charge-sheet has already been submitted and petitioner is in custody since 27.10.2025.

5. Learned A.P.P. for the State has opposed the prayer for bail to the petitioner.

6. Considering the facts and circumstance of the case, general and omnibus nature of accusation, claim based on parity and period of custody, the prayer for grant of bail to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, NDPS Act, Gaya in connection with Barachatti P.S. Case No. 79 of 2024.
