JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-06-2020 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.
Heard the learned counsel for the petitioner and Ms. Anita Kumari Singh, the learned APP appearing for the State.
The present petition is by way of third attempt at the behest of the petitioner herein for grant of bail inasmuch as the earlier prayers made by the petitioner for grant of bail have been rejected by coordinate Benches of this Court vide
Patna High Court CR. MISC. No.21207 of 2020(2) dt.29-06-2020 2/3 orders dated 10.2.2017, 5.9.2017 and 5.9.2018 passed in Criminal Miscellaneous No. 2878 of 2017, Criminal Miscellaneous No. 33579 of 2017 and 55236 of 2018 respectively, in connection with Sessions Trial No. 418 of 2017 arising out of Sarai Ranjan P.S.Case No. 187 of 2016 under Sections 304B and 201/34 of the Indian Penal Code.
The petitioner, who is the husband of the deceased victim lady, is accused of killing his wife on account of non-fulfillment of the demand for dowry.
The only submissions made by the learned counsel for the petitioner is that the petitioner is languishing in custody since 2.3.2017.
Per contra, the learned APP for the State has vehemently opposed the prayer for bail.
Having regard to the facts and circumstances of the case and considering the fact that already the prayer for grant of bail qua the petitioner herein has been rejected earlier on three occasions by coordinate Benches of this Court and there is no change in circumstance so as to warrant re-consideration of the
Patna High Court CR. MISC. No.21207 of 2020(2) dt.29-06-2020 3/3 prayer of the petitioner for grant of bail, I do not find any merit in the present petition, hence, the same stands dismissed.
