JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-02-2019 The petitioner seeks bail in connection with Agiaon (Garhani) P.S.Case No. 86 of 2015 registered under Sections 302, 307 and 324/34 of the Indian Penal Code. Earlier prayer for bail of the petitioner was rejected vide order dated 30.01.2017 and 08.11.2017 passed in Cr. Misc. No. 55188 of 2016 and Cr. Misc. No. 49960 of 2017 respectively and there is direct allegation against the petitioner is of firing upon the victim.

Submission of learned counsel for the petitioner is that in spite of petitioner being in custody since 28.09.2015, the case has not been concluded though other accused person has been granted bail by a co-ordinate Bench of this Court vide order dated 20.11.2018 passed in Cr. Misc. No. 56998 of 2018. Heard learned A.P.P also as well as learned counsel for

No.76741 of 2018(3) dt.07-02-2019 2/2 the informant and perused the report from which it appears that the case is for final argument in such view of the mater, I am not inclined to grant privilege of bail to petitioner. However, 3rd Additional District and Sessions Judge, Bhojpur, Ara is directed to expedite the trial and conduct it on regular basis so as to the same may be concluded within a period of five months.
