JUSTICE SATYAVRAT VERMA ORAL ORDER 29-11-2021 Learned counsel for the petitioner submits that inadvertently the present Criminal Miscellaneous application came to be filed when an appeal had to be preferred as the case is under the SC/ST Act.

Learned counsel for the petitioner further submits that under the SC/ST Act, the appeal has to be preferred within a month from the date of the impugned order but since this Criminal Miscellaneous application, under wrong advice, came to be filed as such now limitation has started running. When the Criminal Miscellaneous application was filed, at that time the limitation had not started running.
