JUSTICE SANJAY PRIYA ORAL JUDGMENT Date : 03-04-2019 Counsel for the petitioner submits that he has cut down few Khair tree from his own land after taking due permission from Respondent No.5- Divisional Forest Officer, Bettiah, Division. He was granted transit permit to transport those wood from villageBedauli to Motihari, East Champaran by Respondent No.5 as per order contained in Annexure- P/3. Aforesaid transit permit was valid for fifteen days to carry those woods, but the petitioner could not carry those wood within aforesaid period because of marriage of his daughter. He has applied before the Respondent No.5 for

Patna High Court CWJC No.6650 of 2019 dt.03-04-2019 2/2 extension of further fifteen days' time to transport those wood vide Annexure- P/4 series on 10.03.2019, which is still pending. In such circumstances, this writ application is disposed off with direction to the Divisional Forest Officer (Respondent No.5) to pass appropriate order on the petition dated 10.03.2019 filed on behalf of the petitioner seeking extension of transit permit within a period of two weeks from the date of receipt/ production of a copy of this order after taking into consideration the fact that petitioner had cut down the tree from his own land after taking necessary permission from the concerned Respondent and he was granted transit permit to carry those wood vide Annexure- P/3.
