JUSTICE MADHURESH PRASAD ORAL ORDER 31-05-2017 Heard learned counsel for the petitioners and learned counsel for the complainant.

Petitioners are apprehending their arrest in connection with Kadamkuan P. S. Case No. 299 of 2016 for the offences punishable under Sections 385, 467, 406, 420 and 506/34 of the Indian Penal Code.

There is a case and counter case. The petitioner no. 1 has filed a complaint case bearing Complaint Case No. 1149 (C) of 2016 which is prior in time, in which cognizance has already been taken against the instant complainant vide order dated 07.06.2016.

Submission made on behalf of the complainant is

Patna High Court Cr.Misc. No.24330 of 2017 (2) dt.31-05-2017 2/2 that on a revision filed in the said case, there is a stay operating in favour of the complainant. The case appears predominantly with respect to some dues and counter claims. In the facts and circumstances, in the event of their arrest or surrender within four weeks from today, the petitioners above named will be released on bail on their furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate-1st Class, Patna in connection with Kadamkuan P.S. Case No. 299 of 2016 subject to all conditions as laid down in Section 438(2) of the Code of Criminal Procedure. (Madhuresh Prasad, J) ajaypd./- U T
