JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 18-05-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Complaint Case No. 859 of 2015 for the offences punishable under sections 323, 341, 504, 506 and 498 (A) of the I.P.C and section 3⁄4 of the Dowry Prohibition Act.

The petitioner is present with his learned counsel. The petitioner submits that he is ready to keep the opposite party no.2 as his wife with honour and dignity. On 24.04.2017 the opposite party no. 2 (complainant) was also ready to live with the petitioner in case he will keep her with honour and dignity, but today the

Patna High Court Cr.Misc. No.7737 of 2017 (5) dt.18-05-2017 2/2 opposite party no.2 has not come due to illness. Under the circumstances, the petitioner is directed to go to his in-laws house within fifteen days and bring back his wife (complainant) to his house. It is expected that the petitioner will keep the complainant with honour and dignity. Thereafter, the petitioner and the opposite party no.2 will appear before the learned court below within six weeks and after being satisfied that both are living together satisfactorily, the petitioner shall be released on provisional bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. S.D.J.M. Banka in connection with above mentioned case and thereafter the learned court below will watch their conduct for three months and after being satisfied with their conduct the provisional bail granted to the petitioner shall be confirmed, failing which the bail granted to the petitioner shall be deemed to be cancelled.

Accordingly, this Criminal Miscellaneous is hereby disposed of.
