No one appears for the State.
The petitioner is apprehending his arrest in connection with Palasi P.S.Case no. 41 of 2017 for the offences registered under Sections 341, 323, 307, 379, 504/34 of the Indian Penal Code, pending in the court of learned A.C.J.M., III, Araria. The allegation against the petitioner is of giving blow on the head of the informant with iron rod. Learned counsel for the petitioner submits that the matter has been settled between the parties.
However, considering the nature of allegation and the injury report available on record as Annexure 1 to the present
Patna High Court Cr.Misc. No.24552 of 2017 (2) dt.07-06-2017 2/2 application, I am not inclined to exercise my discretion to grant privilege of anticipatory bail to the petitioner and the same is rejected. If the petitioner surrenders in the court below within a period of four weeks from today and prays for regular bail, the learned court below shall consider the application on its own merit.
