JUSTICE RAKESH KUMAR ORAL ORDER 15-10-2015 Heard Sri Krishna Prasad, learned Senior Counsel, who was assisted by Sri Bhaskar Shankar, learned counsel for the petitioner, Sri D.P.Tiwary, learned Addl. Public Prosecutor and Sri Amrendra Narayan, learned counsel, who has appeared on behalf of Opp.Party no.2.

The petitioner, apprehending his arrest in connection with Ramgarh P.S. Case no.96/2015, registered for the offence under Sections 420, 409 of the Indian Penal Code, has prayed for grant of anticipatory bail.

Learned counsel for the petitioner submits that the petitioner is a miller. He submits that in similar type of cases, anticipatory bail has been granted to such type of accused on

Patna High Court Cr.Misc. No.47640 of 2015 (2) dt.15-10-2015 2/2 deposit of 20 % of the misappropriated amount. On this very ground, learned counsel for the petitioner makes a prayer for grant of anticipatory bail.

This Court, in number of cases, even after noticing the fact that other accused on deposit of 20 % misappropriated amount have been extended the privilege of anticipatory bail, has rejected the prayer for anticipatory bail. In the present case, total misappropriated amount is more than two crores rupees. Keeping in view nature of accusation and fact disclosed in the F.I.R. I do not find any ground for extending the privilege of anticipatory bail. The petition stands dismissed. (Rakesh Kumar, J) NKS/- U
