This application, for grant of anticipatory bail, arises out of Tarapur Police Station Case No. 76 of 2015, disclosing offences under Sections 144, 341, 337, 504 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, there is land dispute between the parties for making temple on path and on account of that occurrence took place. Moreover, the injuries sustained by the informant are simple in nature and caused by a hard and blunt substance. Hence, the petitioner deserves the privilege of

Learned A.P.P. has opposed the prayer for bail and submitted that there is direct allegation of assault by Khanti against the petitioner, resultantly, upper portion of eye of the informant got ruptured.

Considering the facts and circumstances of the case, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of this petitioner is rejected.
