ANJANA MISHRA ORAL ORDER 22-11-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody since 29.06.2016 in connection with Jehanabad P.S. Case No. 309 of 2016 registered for the offences punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act.

Case diary in the present case was called for, which has since been received.

Learned counsel for the petitioner submits that three persons were arrested and a bag containing a country made pistol was recovered from the three persons so arrested. It is further submitted that the same was not recovered from the exclusive and conscious possession of the present petitioner.

Patna High Court Cr.Misc. No.40650 of 2016 (3) dt.22-11-2016 2/2 Considering the period of custody and that the petitioner has got no criminal antecedent and that there is no further cogent material in the case diary, let the above named petitioner, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad P.S. Case No.309 of 2016.
