====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 26-11-2021 The learned counsel for the petitioners, at the outset, submits that in Para-1, instead of Section 30(a), inadvertently, it has been typed as Section 37(a).
The learned counsel for the petitioners is permitted to make necessary correction within four weeks from today in the first paragraph.
Heard the learned Advocate for the petitioners and the learned APP for the State.
The petitioners seek bail in connection with Kochadhaman P. S. Special (Excise) Case No.74 of 2021, instituted for the offences under Sections 30(a) and 56(b) of the Bihar Prohibition and Excise Act, 2016.
The learned counsel for the petitioners submits that the petitioners are in custody since 21.02.2021 and they are
Patna High Court CR. MISC. No.32339 of 2021(2) dt.26-11-2021 2/2 persons with clean antecedents, charge-sheet has been submitted in the case.
Allegation in the F.I.R. is of recovery of 65.52 litres of liquor from a car in which petitioner was travelling. Learned counsel for the petitioners submits that the car does not belong to the petitioners and as such, they were not aware of the fact that what was loaded in the said car. Learned A.P.P. opposes the bail application.
Considering the fact that the petitioners are in custody since 21.02.2021 and they are persons with clean antecedents, charge-sheet has been submitted in the case, the petitioners, above-named, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Kishanganj in connection with Kochadhaman P. S. Special Case No.74 of 2021.
The application stands allowed.
