2. The petitioner seeks bail in a case registered for the offence punishable under Sections 126(2), 115(2), 87, 351(2), 351(3) and 3(5) of B.N.S..

3. As per prosecution case, this petitioner is alleged to have kidnapped daughter of informant and assaulted son of informant. During investigation, the victim was recovered and in her statement recorded under Section 183 of the B.N.S.S., she supported the prosecution case. The learned trial court has assessed the age of victim as 22 years.

4. Learned counsel for the petitioner submits that petitioner is quite innocent and has falsely been implicated in this case. The present F.I.R. has been lodged after inordinate

Patna High Court CR. MISC. No.24610 of 2026(3) dt.21-07-2026 2/3 delay of 4 days and there is no plausible explanation for the same which itself makes the entire prosecution case doubtful. As a matter of fact, both parties are next door neighbours and petitioner's father had lent a sum of Rs. 20,000/- to the informant and despite several reminders, not a single penny was returned and only with a view to avoid repayment of the loan, this false and concocted case has been lodged. It is further submitted that there is absolutely no accusation of sexual assault or any other overt act against this petitioner. Rest of the allegations are ornamental in order to make the case grave. Charges have already been framed against this petitioner on 15.07.2026 and petitioner, having no criminal antecedents, is in custody since 21.01.2026.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the facts and circumstance of the case, general and omnibus nature of accusation, period of custody and clean antecedents of the petitioner, the prayer for grant of bail to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the
