1. Heard learned counsel for the petitioner, learned GA-7 for the State and the learned counsel appearing on behalf of the opposite party no.11.

The learned counsel appearing on behalf of the petitioner submits that the present contempt application has been filed for initiating a proceeding of contempt against the contemnor/ opposite parties for their willful disobedience of the judgment dated 27.01.2025 in CWJC No.1241 of 2024. The learned counsel for the State submits that the dispute in CWJC No.1241 of 2024 was with respect to Plot No.491 of which Jamabandi was cancelled, but then, the order cancelling Jamabandi was set aside and the State was directed to move before a Court of competent civil jurisdiction for getting the Jamabandi cancelled as the Jamabandi was a long standing Jamabandi. It is further submitted that the instant contempt application has been filed alleging violating of the order dated 27.01.2025 in CWJC No.

1241 of 2024, but then, from perusal of the pleadings made in the contempt application, it would manifest that a generalize pleading has been made. The learned counsel for the State submits that the contemnor can never think of violating the order of this Court in wildest of their dream. It is also submitted that in compliance of the orders of the writ Court, the authorities have moved before a Court of competent civil jurisdiction for getting the Jamabandi cancelled with respect to Plot No.491.

Patna High Court MJC No.1225 of 2025(5) dt.26-09-2025 3/3 in garb of order dated 27.01.2025 in CWJC No.1241 of 2024 is trying to make out a case of contempt with respect to his other plots on which a temple and pond is situated. It is next submitted that temple is situated on Plot No.496 and Pond is situated on Plot No.494, which were not subject matter of CWJC No.1241 of 2024. The learned State counsel asserts and submits based on instruction that authorities have already moved before a Court of civil jurisdiction for getting the Jamabandi cancelled and till the adjudication does not attain finality, the possession of the petitioner on Plot No.491 shall not be disturbed.

3. After hearing the learned counsel for the parties, the Court does not feel persuaded to pursue the contempt proceeding any further.

4. The instant contempt application stands rejected accordingly.
