The petitioner apprehends his arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code and later on, Section 302 of the Indian Penal Code was added in the FIR.

As per the F.I.R., on 28.05.2020 at about 7:00 PM, while the son of informant was returning home, some miscreants surrounded him and on the point of pistol, snatched cash of Rs. 4,000/-, mobile phone and golden chain from the son of informant and when son of informant identified the miscreants and made protest, the miscreants assaulted him, but by chance, a tractor reached there and seeing the said vehicle,

Patna High Court CR. MISC. No.32869 of 2021(5) dt.20-06-2022 2/3 miscreants fled away and thereafter, son of informant was taken to P.H.C. Jalalpur. It is further alleged that on 29.05.2020, while the informant alongwith some villagers went at the house of Dudhnath Singh to know about the same, on the instigation of Dudhnath Singh, some other persons attacked on the informant and his co-villagers, in which, co-villager Subash Kumar succumbed to his injuries.

It is submitted on behalf of petitioner that petitioner is not named in the F.I.R. and his name has transpired during course of investigation. No specific overt act has been alleged against this petitioner and even, son of informant did not identify the petitioner, as one of the miscreant, who assaulted the son of informant. Petitioner has got clean antecedent. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Saran at Chapra in connection with Jalalpur P.S. Case No. 91 of 2020, subject to condition as laid
