JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-05-2019 This is an application for grant of anticipatory bail in connection with Tajpur P.S. Case No.255 of 2018, disclosing offences under Sections 120(B), 365, 366, 366(A), 384, 386, 323, 504, 506/34 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping the daughter of the informant.

Submission of the learned counsel for the petitioner is that due to enmity the petitioner has falsely been implicated in this case and there is no independent witness of the occurrence. Heard learned A.P.P. also who has opposed the prayer for bail stating that from the case diary it shows that the prosecution witnesses have also supported the allegation against the petitioner.

Having heard both sides, in view of the facts and

No.22519 of 2019(3) dt.14-05-2019 2/2 circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner may move before the learned court below for regular bail which will be considered by the learned court below and if possible, be disposed of on the same day.
