The petitioner is apprehending his arrest in connection with Hajipur Sadar P.S.Case No.544 of 2017 registered for offences punishable under Sections 447, 307, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioner that and the other accused persons is that they came over the Darwaza of the informant, made indiscriminate firing and he was arrested on chase by the villagers.
Submission of the learned counsel for the petitioner is that the FIR itself shows that nobody has received injury in this case and the petitioner has been falsely implicated in this case. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.78128 of 2018(2) dt.07-01-2019 2/2 circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court. With the aforesaid observation, this application is dismissed.
