Petitioner who happens to be wife has prayed for transfer of Restitution Case No.02 of 2010 from the court of Principal Judge, Family Court, Nalanda at Biharsharif to the Family Court, Gaya.
It is unfortunate that in spite of giving active indulgence by a Co-ordinate Bench, the dispute amongst the spouses could not be sorted out. The subsequent order-sheets show absence of husband, Opposite Party.
Learned counsel for the Opposite Party has submitted that he has got no contact with his client. Considering the status of the petitioner to be wife,
Patna High Court MJC No.1552 of 2010 dt.10-08-2016 Restitution Case No.02/2010 presently pending before Principal Judge, Family Court, Nalanda at Biharsharif, is directed to be transferred to the Family Court, Gaya. Consequent thereupon, the instant MJC is allowed.
The stay so granted at an earlier occasion vide order dated 07.07.2011 and 10.05.2012 is hereby, vacated. (Aditya Kumar Trivedi, J) perwez U T
