2. Petitioner apprehends arrest in a case registered for the offence punishable under section 115 ( 2 ), 118 ( 2 ), 127

(1) , 109, 303 ( 2 ), 3(5) of BNS 2023 .

3 . As per the prosecution case , informant namely , Triveni Ray alleged that on 12.10.2024 at 12.00 PM, while his son , Mahesh Rai was returning from Durga Puja fair, in the meantime , all the F.I.R., named accused persons along with 2 unknown persons came there and assaulted his son . It is further alleged that this petitioner assaulted him with knife on his stomach due to which he became unconscious. Doctor has found the injury grievous in nature .

4. Learned counsel for the petitioner submits that due to land dispute a free fight took place between the parties in which both sides sustained injuries. Case and counter case . Petitioner has also sustained grievous injury and claims clean antecedent.

5 . Learned counsel for the State opposed the prayer for bail and submitted that injury allegedly caused by this petitioner is grievous in nature .

6. Considering the nature of accusation , and injury and gravity of offence , prayer for pre-arrest bail of the petitioner is rejected.
