Heard learned counsel for the petitioner as well as learned APP for the State through video conferencing. The petitioner apprehends his arrest in connection with Paroo P.S. Case No. 237 of 2019, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 504 & 506 of the Indian Penal Code. Learned counsel for the petitioner has submitted that the case of the present petitioner is exactly same to co-accused Birendra Rai @ Birendra Kumar and Phulindra Kumar Rai @ Phalindra Rai, who have been granted anticipatory bail by

Patna High Court CR. MISC. No.32884 of 2021(2) dt.01-02-2022 2/2 coordinate Bench of this Court in Cr. Misc No. 18065 of 2020 vide order 09.09.2020.

Considering the fact that other co-accused on similar footing have been granted anticipatory bail by the coordinate Bench of this Court, let the petitioner be released on anticipatory bail in the event of his arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned additional Chief Judicial Magistrate, III, West Muzaffarpur, in connection with Paroo P.S. Case No. 237 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
