2. The petitioner is apprehending his arrest in connection with Complaint Case No. 903 of 2024, Trial No. 3554 of 2024 for the offence punishable under Sections 498(A) of the Indian Penal Code, lodged by the complainant, Varsha Kumari.
3. The allegation in the complaint is that the marriage took place on 30.11.2020 but she was always tortured for dowry and the allegation is that on one fateful morning, they tried to burn her by opening gas cylinder and thereafter ousted her, this led to the case.
4. The matter was earlier sent to the Mediation Center but as per the report dated 07.11.2025, it failed.

Learned counsel for the petitioner submits that though they could not settle the matter, being his legally wedded wife and there is also a four years old daughter, on his own, would like to pay Rs. 10,000/- to the lady as also Rs. 5,000/- to the female child totalling Rs. 15,000/- per month which shall be paid in her bank account (State Bank of India, A/c No. 40085737023, IFSC-SBIN0002911).
6. Learned counsel representing the informant on the other hand though opposes the prayer concede that now that he wants to give financial support, she is not opposing the prayer for anticipatory bail.
7. Considering the aforesaid background, this Court is inclined to extend him the privilege of anticipatory bail with conditions subject to payment of Rs. 15,000/- as recorded above by 10th of every month in the Bank A/c No. 40085737023.
8. Failure to do so, the opposite party no. 2 shall be free to take steps for cancellation of his bail bond.
9. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Complaint Case No.
Patna High Court CR. MISC. No.25973 of 2025(5) dt.28-11-2025 3/3 903 of 2024 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
(i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;
(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Adnan/- U T
