The petitioner, who is in custody since 22.03.2020 and claims to be a person of clean antecedent seeks bail in connection with C2/205/20 instituted for the offences under Section 30(A) of the Bihar Prohibition and Excise Act, 2016. The petitioner was arrested by the S.S.B. personnel along with six bicycles and 810 litres of Nepali liquor.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.21868 of 2020(2) dt.09-07-2020 2/2 that some of the accused persons were crossing the border with liquor on their respective bicycles and the petitioner was only a bystander. The actual culprits fled away and petitioner has been arrested on mistaken identity.

Considering the afore-stated facts and the period of custody of the petitioner, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-II-cum-Special Judge, Excise Act, Sitamarhi, in connection with C2/205/20.
