2. Petitioner seeks regular bail in connection with Naubatpur P.S. Case No. 80 of 2024 in a case registered for the offences punishable under Sections 302 / 34 of the Indian Penal Code and under Section 27 of Arms Act.

3. As per prosecution story, informant suspects that this petitioner along with other co-accused persons killed his father. Informant alleges that his father had love affair with coaccused Geeta Devi and had lodged a case against father of the informant in which father of informant was behind the bar and on the basis of compromise, father of informant came out of jail and as per settlement, co-accused Geeta Devi was given a new

Patna High Court CR. MISC. No.30352 of 2025(2) dt.04-07-2025 2/3 house but thereafter, Geeta Devi and her sons, including the petitioner, demanded Rs. 11,00,000/- and also threatened to kill father of informant.

Learned counsel for the petitioner submits that from perusal of the FIR it appears that informant is not the eyewitness to the alleged occurrence and only because of an old dispute, a suspicion has been raised against this petitioner. During the course of investigation, none of the witnesses have claimed to have seen the occurrence or seen this petitioner committing the offence. Chargesheet has already been submitted. Similarly situate co-accused Sonu Kumar has already been granted bail by this Court vide order dated 05.03.2025 passed in Cr. Misc. No. 772 of 2025. Petitioner claims clean antecedent. Petitioner is in custody since 16.07.2024.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-
