====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 08-03-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Sasaram (T) (Darigaon) P.S. Case No. 1028 of 2018, instituted for the offence under Section(s) 302 and 201 of the Indian Penal Code. It is alleged in the written report that father of the informant went with this petitioner by Motorcycle and did not return. The informant alleged that this petitioner had taken his father to Sipha river and committed his murder. Case diary has been received.

In the case diary it is mentioned that dead body has been recovered from Sipha river situated near Kaimur mountain which was identified by the informant and his family members.

Patna High Court CR. MISC. No.77346 of 2018(3) dt.08-03-2019 2/2 In this manner, mere suspicion has been raised against the petitioner in the written report. There is no allegation of specific overt act against the petitioner. Petitioner is in custody since 18.7.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas (Sasaram) in connection with Sasaram (T) (Darigaon) P.S. Case No. 1028 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
