JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-04-2015 At the outset, it is stated that petitioner no.1 has been arrested during the pendency of this application and this application is dismissed to the extent it relates to petitioner no.1. Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 341, 323,307, 504/34 of the Indian Penal Code and Section 25( 1-B)a 26/27 of the Arms Act.

From the First Information Report it appears that the occurrence took place out of civil dispute between the parties. Learned counsel for the informant has submitted that

In view of the nature of dispute between the parties and the allegations in the First Information Report, let petitioners above named in the event of his arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in Ballia P.S. Case No. 267 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
