This is a petition for grant of anticipatory bail for offence under Sections 466, 420, 504 and 506 of the Indian Penal Code and 138 of the Negotiable Instrument Act. The first information report reveals that there is contractual dispute between the parties arising out of sale and purchase of a pick-up van.
Submission of the learned counsel for the petitioner is that the allegation does not make out a case of cheating and the offence under Section 138 of the Negotiable Instrument Act is bailable.
Considering the aforesaid fact, let the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with V-Nagar (Vidyapatinagar) P.S. Case No. 118 of 2016 to the satisfaction of the Additional Chief Judicial Magistrate, Dalsingsarai, Samastipur, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
