====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-04-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Bhagwanpur P.S. Case No. 06 of 2019, registered under Section 30 (A) of the Bihar Excise Act.

On receiving secret information about keeping the illegal liquor in the hut of Maksudan Mahto, father of the petitioner, in village-Rahma West, the informant and other police officials went there on 05.01.2019, at about 2.30 P.M. On seeing the informant and others, one person succeeded to flee away but petitioner was apprehended. On search of hut, 317 litres and 670 ml Indian made foreign liquor in different bottles, kept in cartons, were recovered. On query, petitioner disclosed

Patna High Court CR. MISC. No.23378 of 2019(2) dt.12-04-2019 2/2 that aforesaid liquor was of Kamlesh Rai and his father used to do work on remuneration of Rs.25 per day paid by Kamlesh Rai and this petitioner also disclosed the name of Maksudan Mahto, who succeeded to flee away from there.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and is in custody since 06.01.2019.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge-cum-Special Judge Excise, Vaishali at Hajipur, in connection with Bhagwanpur P.S.
