Mr. Matloob Rab ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 15-01-2019 Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in Bhargama P. S. Case No. 96 of 2016 instituted for the offence under Section(s) 147, 149, 341, 323, 307, 504 and 506 of the Indian Penal Code. In the written report, it is alleged that this petitioner along with Naresh Sah assaulted wife of the informant with iron rod on the head 2-3 times.

The injury report of the wife of informant is annexed as Annexure-2 series to the bail petition, wherein, doctor has found only one lacerated wound on the head in left side which was opined to be simple in nature caused by hard and blunt substance.

Learned counsel for petitioner submits that said

Patna High Court Cr.Misc. No.77599 of 2018(2) dt.15-01-2019 2/2 Naresh Sah has already been granted bail by co-ordinate Bench of this Court by order dated 18.10.2016 passed in Cr. Misc. no. 43056 of 2016.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M. Araria, in connection with Bhargama P. S. Case No. 96 of 2016, G.R. case no. 2426 of 2016 subject to the condition that both the bailors shall be the close relative of the petitioner.
