The petitioner apprehends his arrest in connection with Gopalpur P.S.Case No. 49 of 2016 registered under Section 307 and other Sections of the Indian Penal Code. The informant alleged that the accused persons along with the petitioner having different arms assaulted him inflicting injuries on his head. The petitioner is alleged to have entered into the house of the informant and committed theft of money and the wife of the petitioner is alleged to have taken away ornaments from the house.
All the accused persons except the petitioner who are alleged to have assaulted, have been granted anticipatory bail by a Bench of this Court vide order dated 18.8.2016 passed in
Patna High Court Cr.Misc. No.46573 of 2016 (2) dt.01-12-2016 Cr.Misc.No. 32945 of 2016.
The case of the petitioner stands on the similar footing.
Considering the above fact, let the petitioner above named in the event of his arrest or surrender in the Court below within a period of four weeks from today, be enlarged on bail on furnishing bail bonds of Rs. 25,000/- with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Bettiah, West Champaran, in connection with Gopalpur P.S. Case No. 49 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
