The petitioner is in custody since 01.08.2016 in connection with Muffasil P.S. Case No. 345 of 2016, registered for offences punishable under Section 47 of the Bihar Excise Amendment Act, 2016.

Allegation is of recovery of 37.6 litres of country made liquor from the possession of the petitioner. Learned counsel for the petitioner has submitted that the petitioner was not arrested on the spot and due to dirty local politics, his name has been dragged in this case. The petitioner has no criminal antecedent and has been languishing in jail custody since 01.08.2016

No.49423 of 2016 (2) dt.13-12-2016 2/2 Having heard both sides and considering the fact that the petitioner was not arrested on the spot and also the fact that he has a clean antecedent and he has been in jail custody since 01.08.2016, let the petitioner above named, be enlarged on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Muffasil P.S. Case No. 345 of 2016.
