JUSTICE SUDHIR SINGH ORAL ORDER 30-04-2015 The petitioner is apprehending his arrest in connection with Complaint Case No. C-1/1837/13 for the offence under Section 498A of the Indian Penal Code.

Heard learned counsel for the petitioner and the State. The prosecution story, in brief, is that the complainant was married with the petitioner according to Muslim rites and customs. She was tortured by the petitioner for demand of money to open the business. The petitioner forced the complainant to get the land sold by her father and gave money to the petitioner to open the business. When she did not agree, the petitioner and other family members assaulted the complainant.

It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in this case and the

Patna High Court Cr.Misc. No.49822 of 2014 (2) dt.30-04-2015 allegation made on behalf of the complainant is baseless. Further it has been submitted that the petitioner is a daily wage labourer. On behalf of the State it ahs been submitted that the petitioner is the husband of the complainant and there is specific allegation against him.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest/surrender in the court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Complaint Case No. C-1/1837/13 , subject to the conditions, as laid down u/s 438(2) Cr.P.C. with an additional condition that the petitioner shall deposit an amount of Rs. 1500/- (fifteen hundred) every month in the court below and the same shall be released in favour of the complainant.
