The petitioner seeks bail in CIS No. 1067 of 2018 arising out of Aurangabad (Town) P.S. Case No. 327 of 2018 instituted for the offence under Section 414 of the Indian Penal Code, Sections 30(a) and 38(i) of Bihar Prohibition and Excise Act.
In the written report it is alleged that 400 pouches each containing 200 ml. of country made liquor and 27 bottles each containing 375 ml. of foreign liquor have been recovered from the car and hidden under the land near the house of this petitioner. It is further alleged that one Motorcycle has also been recovered from possession of the petitioner.
Patna High Court Cr.Misc. No.77221 of 2018(2) dt.21-12-2018 2/2 Counsel for the petitioner submits that petitioner has been made accused merely on suspicion. The recovery of alleged liquor does not belong to him. He has no criminal antecedent.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII-cum-Special judge (Excise), Aurangabad in connection with CIS No. 1067 of 2018 arising out of Aurangabad (Town) P.S. Case No. 327 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
