JUSTICE SUDHIR SINGH ORAL ORDER 03-02-2016 Learned counsel for the petitioners seeks permission to withdraw the application on behalf of petitioner nos. 4 and 6 (Sanjay Yadav and Ram Pyare Yadav @ Pyare Yadav) as they have been arrested during the pendency of this application. The application is dismissed as withdrawn so far petitioner nos. 4 and 6 are concerned.
Heard learned counsel for the petitioner nos. 1,2,3,5,7,8 and 9 and the State.
The petitioner nos.1,2,3,5,7,8 and 9 are apprehending their arrest in connection with Chand P.S. Case No. 66 of 2015 instituted under Sections 341, 323, 325, 307 and 504/34 of the Indian Penal Code.
The prosecution story, in brief, is that while the
Patna High Court Cr.Misc. No.48537 of 2015 (3) dt.03-02-2016 2/2 informant' nice was returning back to home after attending coaching classes then on the way some of the accused tried to outrage her modesty, she raised alarm and the persons working in the agricultural field reached for the rescue, thereafter the accused persons are alleged to have assaulted them with Garasa, Lathi, Spear and Khanti causing injury to several persons. It has been submitted on behalf of petitioner nos.1,2,3, 5,7,8 and 9 that they have no criminal antecedent. It is a case and counter case. From perusal of injury report it appears that the injuries are simple in nature.
On behalf of the State, it has bean submitted that the petitioners are named in the FIR.
Considering the aforesaid facts, let the above named petitioner nos. 1,2,3,5,7,8 and 9 ( Pintu Yadav, Sanjeev Yadav, Parveen Yadav @ Praveen Yadav, Shyam Bihari Yadav, Shyam Lal Yadav, Manoj Yadav and Ram Dulare Yadav), in the event of their arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Birendra Prasad, learned J.M., 1st Class, Kaimur at Bhabua in connection with Chand P.S.Case No. 66 of 2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
