JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 21-12-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.
The petitioner wants to renew his prayer for bail which was earlier rejected by order dated 24.05.2016 passed in Cr. Misc. No. 22213 of 2016 on the ground that the petitioner is suffering in custody since 04.02.2016, it was the case of love affair, the victim girl is major one and as such the petitioner deserves sympathetic consideration, to which the learned A.P.P. seriously opposes by submitting that the victim girl in her statement recorded under section 164 of the Cr.P.C. has stated the name of the petitioner as kidnapper as well as that he raped her several times.
In the facts and circumstances as stated above, finding
Patna High Court Cr.Misc. No.54743 of 2016 (2) dt.21-12-2016 2/2 no good ground for reconsideration of prayer for bail, again prayer for bail of the petitioner stands rejected in connection with Sessions Trial No. 276 of 2016 arising out of Bhagwanpur P.S. Case No. 13 of 2016 pending in the court of Sessions Judge, Kaimur at Bhabua.
However, let the trial be expedited and concluded as early as possible preferably within a period of six months from the date of receipt/production of a copy of this order. (Jitendra Mohan Sharma, J) Abhay/- U T
