Petitioner is in custody in connection with Goh PS Case No. 86 of 2011 for the alleged offence under Sections 384, 435, 379,341, 147. 323, 148, 149 of the Indian Penal Code, Section 27 of the Arms Act and Section 17 of Criminal Law Amendment Act.
Learned counsel representing the petitioner submits that the petitioner is in custody since 07.09.2018. He also referred to the case of Bindeshwari Paswan who has been granted bail vide order dated 12.05.2017 and Radheshwar Paswan who has been granted bail vide order dated 07.03.2017. It appears that in the instant case co-accused Mrityunjay Mishra,
Patna High Court Cr.Misc. No.77367 of 2018(2) dt.11-01-2019 2/2 Dinesh Chandrabanshi, Amit Chandrabanshi, Jitendra Singh have been granted bail by co-ordinate Bench of this Court. Considering the totality of the facts and circumstances of the case, particularly the fact that similarly circumstanced several other co-accused persons have been granted bail, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Swarn Prabhat, Judicial Magistrate 1st Class, Daudnaga, District Aurangabad in connection with Goh PS Case No. 86 of 2011.
